What probate actually involves

Probate is the court-supervised process of validating a will, appointing someone to act for the estate, paying debts and taxes, and distributing what remains. Depending on the assets involved, it can take from a few months to more than a year.

  1. 01

    Petition & appointment

We prepare and file the petition to open the estate and have the personal representative formally appointed.

  2. 02

    Inventory & valuation

Assets are located, appraised where necessary, and reported to the court and beneficiaries.

  3. 03

    Creditors & taxes

We publish notice, evaluate claims, and coordinate estate, income, and (where applicable) estate tax filings.

  4. 04

    Accounting & distribution

A clear accounting is provided to beneficiaries, and assets are distributed under the will or intestate law.

  5. 05

    Closing the estate

Final filings and releases close the estate and discharge the personal representative.

Independent administration

The most common path in Texas — faster and less costly when the will is uncontested and heirs are in agreement.

Dependent administration

Used when the estate requires closer court oversight, such as disputes among heirs or creditor concerns.

Muniment of title

A streamlined Texas probate option when the only asset needing transfer is real estate and there are no debts.
